Golf Terms and Conditions

^{THE RANCH AT LAGUNA BEACH GOLF COURSE AND CART LIABILITY TERMS & CONDITIONS}

Golf can be an enjoyable and exciting activity. However, like many recreational activities that require physical exertion, participating in the game of golf carries with it the risk of physical injury. By proceeding, I (“Group,” Participant(s),” or “Player(s)”) agree to said risks associated with engaging in the game of golf at The Ranch at Laguna Beach (“Owner,” or “Laguna Beach Golf & Bungalow Village L.L.C.”), which includes the following:

• Impacts with or from sporting equipment such as being hit by a golf ball, golf club or other related equipment
• Damage sustained from operating a golf vehicle.
• Golf courses are heavily populated with trees and vegetation which may cause slippages, tripping or falling due to the nature of the terrain
• The terrain can also contain heightened risks depending on the prevailing weather conditions such as excessive heat, thunderstorms, or slippages on wet or slippery surfaces
• Unaccustomed physical exertion
• Rapid or adverse changes in weather
• Being stung or bitten by any animal found on course; and/or travelling around the golf course including crossing any roads
• Aggravate an existing injury (especially shoulder injuries) or suffer serious injury, disease, or death.
• Ensure to wear an appropriate clothing (in the hotter months) and apply maximum protection sun-protection on all exposed skin
• Agree to comply promptly with all directions given to you by your Instructor, employees or agents of The Ranch at Laguna Beach or by any golf professional on duty that you participate at your own risk
• All cart operators must have a valid driver’s license and proof of insurance and be 18 years of age or older.
• Vehicles shall not be operated in a manner that may endanger any passengers or other individuals (i.e. pedestrians), or harm property.
• One rider per seat in the golf cart at any time.  Persons are not permitted to ride without having a designated seat. No more than 2 golf bags shall be in the golf cart at any time. 
• Familiarize yourself with and observe all traffic rules:
  • Use hand signals when turning or stopping.
  • Golf carts are not permitted on the golf course without a booked tee-time.
  • Golf carts are not permitted on any pedestrian walkways.
  • Golf carts must follow all regulations regarding parking, may not park in fire lanes or ADA areas.
  • Park golf carts on a level and steady ground. Always use parking brake when not in use. 
  • Golf carts are not permitted off property.
• Note that the cart has forward, neutral and reverse gears.  When in reverse, you should hear a buzzing sound.
• Please remove the golf cart key when not in use.

Assumption of Risks:  Playing on the golf course at The Ranch at Laguna beach at 31106 Coast Hwy, Laguna Beach, CA 9261 and the use and control of any golf cart, by its very nature, carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries.  The specific risks vary from one activity to another, from one location to another, from one individual to another, but the risks of playing, driving, or riding range from minor injuries to major and catastrophic injuries including paralysis and death.  I understand and agree that it is my responsibility to assess the hazards presented by my participation and further agree that I am the ultimate judge as to whether I can partake without risk of harm to myself and others. 

Indemnification and Hold Harmless: I also agree to DEFEND, INDEMNIFY AND HOLD HARMLESS the Owner (Laguna Beach Golf & Bungalow Village L.L.C.), its members, officers’ employees and agents from and against any and all claims, demands, actions or causes of actions, for costs, attorney’s fees, expenses or damages to personal property, or personal injury, or death, which may result from any activity on the golf course.  All litigation must be handled in the local judicial system.  

Severability:  The undersigned further expressly agrees that the forgoing terms and conditions and assumption of risk is intended to be as broad and inclusive as is permitted by the law of the State of California and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

Acknowledgement of Understanding:  I have read the terms and conditions of liability, assumption of risk, and indemnity agreement, fully understand its terms and understand that I am giving up substantial rights, including my right to sue the Owner (Laguna Beach Golf & Bungalow Village L.L.C.), its members, officers, employees and agents.  I also understand that this agreement binds my heirs, executors, personal representatives, attorneys-of-law, attorneys-in-fact, administrators and assigns, as well as myself.  I acknowledge that I am signing the agreement freely and voluntarily and intend by my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.  I hereby assert that my use of said cart is voluntary and that I knowingly assume all such risks incident to using said cart.

The agreement for services provided to you by the Owner (Laguna Beach Golf & Bungalow Village L.L.C.) hereby excludes any liability that results from breach of any implied or express warranty. The services of The Ranch at Laguna Beach will be rendered with due care and skill and excludes any implied or express warranty and any liability for their breach. Any equipment provided by The Ranch at Laguna Beach in connection with the golfing activities or separately will be fit for the purpose for which they are supplied; and The Ranch at Laguna Beach will have no liability to you for personal injury, disease or death arising from the services and/or equipment that The Ranch at Laguna Beach provides to you.
